Overview

This website and online store are operated under the Burvonti brand by Aurevonti LLC, a Wyoming limited liability company ("Burvonti," "we," "us," or "our"). Burvonti provides this website, including its information, content, features, tools, products, and related services (collectively, the "Services"). Our store is powered by Shopify.

These Terms of Service (the "Terms"), together with the policies and terms linked or incorporated below, govern your access to and use of the Services and any purchase from Burvonti. Please read them carefully. By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Nothing in these Terms limits rights or remedies that cannot lawfully be limited under applicable consumer law.

1. Eligibility and accounts

You must be at least the age of majority where you live to place an order. A minor may use the Services only with the involvement and permission of a parent or legal guardian.

Information you provide must be accurate, current, and complete. You are responsible for safeguarding your account credentials and for activity conducted through your account. Please notify us promptly at support@burvonti.com if you believe your account has been used without authorization.

2. Products and product information

We work to present product descriptions, images, dimensions, materials, prices, and availability accurately. Screen settings, lighting, scale, and photography can affect how a product, gemstone, diamond, or metal color appears. Images may be enlarged to show detail and are not necessarily shown at actual size.

Jewelry dimensions, weights, and carat totals may involve customary measurement and manufacturing tolerances. When an independent grading report accompanies a diamond, the report for that specific diamond controls its laboratory-graded characteristics. Availability, specifications, and pricing may change before an order is accepted.

We may modify or discontinue products and may limit quantities, customers, geographic regions, or jurisdictions when reasonably necessary. Any material customization, specification, or service commitment must appear in the applicable product page, written quote, CAD approval, order confirmation, or another written agreement from Burvonti.

3. Orders and acceptance

Submitting an order is an offer to purchase. An automated acknowledgment confirms that we received the order; it does not require us to accept it. We may verify product availability, pricing, payment, shipping information, and fraud indicators before acceptance. We may decline or cancel an order for a lawful reason, including an unavailable item, an obvious pricing or description error, suspected fraud, prohibited resale, or an inability to fulfill the requested specification. If we cancel after payment has been captured, we will refund the affected amount.

Please review your order carefully before submitting it. Contact support@burvonti.com promptly if you request a change or cancellation. We cannot guarantee a change or cancellation after sourcing, fabrication, customization, fulfillment, or shipment has begun. Returns and exchanges are governed by our Return and Refund Policy.

Purchases are intended for personal or household use. You may not purchase products for unauthorized commercial resale or export.

4. Prices, payment, taxes, and promotions

The price charged is the price shown at checkout and in the order confirmation, subject to correction of an obvious error. Applicable taxes, shipping charges, duties, discounts, and other charges are displayed at checkout or addressed in the applicable policy. International pricing and delivery terms are described in our Shipping Policy.

You authorize us and our payment providers to charge the payment method you submit for all amounts shown at checkout. You represent that you are authorized to use that payment method and agree to provide accurate billing information.

Promotions may be subject to separate eligibility, timing, product, and combination restrictions. If promotion terms conflict with these Terms regarding that promotion, the promotion terms control.

5. Made-to-order and custom jewelry

Some Burvonti pieces are made to order. Estimated fabrication and delivery timing is described on the applicable product page, quote, order confirmation, or Shipping Policy. Timing can change if specifications, approvals, sizing, sourcing, payment, or delivery information changes.

A custom-design brief is a request for review and does not itself place an order, reserve a diamond, authorize a charge, or begin CAD or production. Unless a written project agreement states otherwise:

• a written quote defines the proposed scope, specifications, price, and estimated timing;
• a 30% deposit begins CAD work;
• two CAD revision rounds are included;
• you may cancel within three business days after receiving the first-round CAD for a full refund of the deposit;
• continuing with the design or requesting a revision after receiving the first-round CAD makes the deposit non-refundable;
• final CAD approval and payment of the remaining balance authorize production; and
• after production begins, a change-of-mind cancellation or return is not available.

Incorrect items, transit damage, and confirmed manufacturing defects are handled separately under the applicable return, service, and warranty policies. If a custom quote or project agreement conflicts with this section, the signed or expressly accepted project-specific agreement controls.

6. Shipping, delivery, title, and risk

Delivery dates are estimates unless Burvonti expressly agrees otherwise in writing. Carrier delays, customs review, severe weather, address errors, payment verification, and events outside our reasonable control can affect delivery.

Title and risk of loss pass to you when the order is delivered to the shipping address or authorized recipient, except where applicable law requires otherwise. Signature, address, insurance, carrier, and international delivery requirements are described in our Shipping Policy. Please report suspected loss, tampering, an incorrect item, or transit damage promptly so we can investigate with the carrier and insurer.

7. Returns, exchanges, resizing, and warranty

Eligibility, timing, item condition, return limits, certificate or restoration fees, exclusions, inspection, and refund procedures are governed by the Return and Refund Policy. Where eligible, Burvonti's written Lifetime Warranty and Diamond Upgrade terms apply.

Third-party alteration, repair, engraving, or resizing may affect return, exchange, resizing, warranty, or upgrade eligibility. Nothing in these Terms excludes obligations that apply to an incorrect item, transit damage, manufacturing defect, or non-waivable consumer right.

8. Comparative purchasing and policy abuse

Burvonti may limit or refuse transactions or return privileges when there is reasonable evidence of fraud, unauthorized resale, abusive conduct, or comparative purchasing, meaning ordering multiple pieces with the preplanned intent to retain only one, as further described in our Return and Refund Policy. We will apply these measures consistently with applicable law and any non-waivable consumer rights.

9. Intellectual property

The Services and their content, including text, photographs, graphics, videos, interfaces, product presentations, logos, designs, and software, are owned by or licensed to Burvonti and are protected by applicable intellectual-property laws. Burvonti names, logos, product names, and slogans are trademarks or trade dress of Burvonti or their respective owners.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial shopping and informational purposes. You may not reproduce, distribute, modify, publicly display, create derivative works from, scrape, sell, or commercially exploit the Services or their content without prior written permission, except as permitted by applicable law.

10. Reviews, feedback, and user content

If you submit a review, photograph, design note, comment, suggestion, or other content ("User Content"), you remain responsible for it and represent that you have the rights needed to submit it. User Content must not be unlawful, deceptive, defamatory, abusive, infringing, invasive of privacy, or contain malicious code or another person's confidential information.

You grant Burvonti a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, format, display, and distribute User Content for operating, improving, and promoting the Services, subject to our Privacy Policy and any more specific written permission request. This license does not transfer ownership of your User Content to Burvonti. We may moderate or remove User Content when reasonably necessary, but we are not required to monitor all User Content.

Design references submitted for a custom project communicate preferences only. They do not authorize Burvonti or the customer to copy another party's protected design, and Burvonti may decline a request that raises intellectual-property concerns.

11. Third-party tools and links

The Services may include tools, payment methods, applications, or links operated by third parties. Their own terms and privacy practices may apply. We do not control third-party websites and are not responsible for their independent content, availability, or practices. Please review the applicable third-party terms before using them.

12. Relationship with Shopify

Burvonti is powered by Shopify, which enables us to provide the Services. Sales made through our store are transactions directly between you and Burvonti. Shopify is not the seller of Burvonti products and is not responsible for the products, fulfillment, customer service, or other aspects of those sales. To the extent permitted by law, you release Shopify and its affiliates from claims arising solely from your purchase transaction with Burvonti.

13. Privacy

Personal information collected through the Services is handled as described in our Privacy Policy. Because Shopify hosts the store, Shopify also processes certain information as described in the privacy notices linked from our Privacy Policy.

14. Prohibited uses

You may use the Services only for lawful purposes. You must not:

• violate applicable law or another person's rights;
• submit false, misleading, fraudulent, or unauthorized information;
• interfere with the operation, security, or availability of the Services;
• introduce malware or attempt unauthorized access;
• collect personal information about others without authorization;
• use the Services for spam, phishing, harassment, impersonation, or unlawful solicitation;
• bypass access controls, rate limits, robot exclusions, or security measures; or
• use automated extraction, scraping, or agent systems in a manner that violates these Terms or our posted technical controls.

We may restrict access when reasonably necessary to protect customers, Burvonti, Shopify, or the Services.

15. Errors and corrections

Information may occasionally contain typographical errors, inaccurate availability, pricing errors, or omissions. We may correct an error or update information. If a material error affects an order you submitted, we will contact you when reasonably possible and may offer the corrected order or cancel and refund the affected amount. We will not use this section to limit rights that applicable law gives you.

16. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access for a material breach of these Terms, fraud, threats to security, unlawful activity, or conduct that harms the Services or other users. Rights and obligations that by their nature should survive termination will remain in effect, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, governing law, and dispute provisions.

17. Disclaimer of warranties

Except for express product commitments in an applicable product description, order confirmation, written quote, warranty, or other written agreement, and except for rights that cannot be excluded by law, the Services are provided "as is" and "as available." We do not warrant that the website will always be uninterrupted, error-free, or free of harmful components.

This section does not limit Burvonti's obligations under its published warranty, return policy, an accepted order, or applicable consumer-protection law. Some jurisdictions do not allow certain warranty exclusions, so those exclusions may not apply to you.

18. Limitation of liability

To the fullest extent permitted by law, Burvonti and its officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits, revenue, data, or business opportunity, arising from the Services or these Terms.

To the fullest extent permitted by law, Burvonti's total liability for a claim relating to a product or order will not exceed the amount you paid for the product or order giving rise to the claim. These limitations do not apply to liability that cannot lawfully be excluded or limited, including where applicable liability for fraud, willful misconduct, gross negligence, or personal injury caused by negligence.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold Burvonti and its affiliates, officers, employees, contractors, licensors, and service providers harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from Burvonti's own conduct.

20. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-law principles, except that mandatory consumer protections in your place of residence continue to apply where required.

Before filing a claim, you and Burvonti agree to make a good-faith effort to resolve the dispute by contacting the other party and allowing 30 days for a response. Unless applicable law permits or requires another forum, judicial proceedings arising from these Terms or the Services will be brought in the state or federal courts located in Wyoming, and each party consents to their jurisdiction.

These Terms do not require binding arbitration and do not waive a right to a jury trial or participation in a class proceeding.

21. Severability, waiver, and entire agreement

If any provision is held unlawful or unenforceable, it will be enforced to the maximum extent permitted and severed only to the extent necessary; the remaining provisions remain effective. A failure to enforce a provision is not a waiver.

These Terms and the policies and written terms incorporated by reference form the agreement governing your use of the Services. Product-specific terms, an accepted custom quote, or another written agreement may supplement these Terms. If a project-specific agreement expressly conflicts with these Terms, the project-specific agreement controls for that project.

22. Assignment

You may not assign these Terms without our written consent. We may assign these Terms as part of a merger, reorganization, financing, sale of assets, or transfer of the Burvonti business, subject to applicable law.

23. Changes to these Terms

We may update these Terms by posting a revised version and updating the "Last updated" date. When applicable law requires additional notice, we will provide it. Changes apply prospectively from their effective date and do not retroactively change an accepted order unless required by law or agreed with you.
